Privacy Policy

Weatherkind is a weather service, not a data broker. We use personal information to provide and secure the products you choose, communicate with you, and run our business. We do not sell personal information or use it for targeted or cross-context behavioral advertising.

1. Scope and Who We Are

This Privacy Policy explains how Electric Pass Labs, LLC d/b/a Weatherkind ("Weatherkind," "we," "us," or "our") collects, uses, discloses, and retains personal information when you use our websites, mobile applications, Mission Control, weather API, developer tools, dashboards, waitlists, support, and related services (collectively, the "Service"). Weatherkind is the controller of personal information described here unless we process it on behalf of a business customer. Questions and requests may be sent to hello@weatherkind.com.

This Policy does not govern third-party websites, app stores, devices, weather-data publishers, payment providers, or integrations that have their own privacy practices. If a Weatherkind business customer gives you access to Mission Control or submits your information through its integration, that customer may control the data and its privacy notice may also apply.

2. Information We Collect

Depending on the products you use, we may collect:

• Contact and account information: name, work email, phone number, organization, role, login details, account settings, authorized users, communications preferences, and records of legal acceptance such as the Terms version, acceptance time, and acceptance method.
• Location and weather-request information: precise or approximate coordinates, place names, saved or searched locations, requested variables, forecast times, map areas, and returned weather data. A requested coordinate may be your device location, a business site, or any place you choose.
• Mission Control and station information: site names and coordinates; station identifiers, metadata, readings, health, calibration, and connection status; thresholds, alert rules, recipients, delivery channels, webhook endpoints, acknowledgments, and notification history; annotations and dashboard settings.
• API and developer information: API-key and account identifiers, scopes, endpoints and parameters requested, timestamps, response status and latency, quota and rate-limit events, usage totals, integration metadata, authentication outcomes, and security events.
• Transaction and commercial information: plan, subscription status, metered usage, invoices, billing contact, payment status, and limited transaction details. Payment processors and app stores process full payment credentials under their own policies; we do not need to receive full card numbers.
• Support, sales, and waitlist information: email address, message content, attachments, meeting notes, product interests, feedback, and records of our response.
• Device, network, and diagnostic information: IP address, date and time, URL or route, referral information, browser/app version, operating system, device and language settings, HTTP headers, error and crash information, and security or request logs.

We do not ask you to submit sensitive personal information unrelated to weather service delivery. Please do not provide protected health information, payment-card data, government identifiers, passwords, special-category data, or information about children through site labels, station metadata, webhooks, support messages, or API payloads.

You may choose not to provide personal information, but we may be unable to provide the feature that needs it—for example, a coordinate is needed to return location-specific weather and contact information is needed to create a business account or deliver an alert.

3. Sources of Information

We collect information:

• directly from you when you request weather, join a waitlist, obtain a key, configure a product, purchase a plan, or contact us;
• from your device, browser, application, server, station, sensor, or other connected system when it interacts with the Service;
• from an organization that administers your access or includes you as an authorized user or alert recipient;
• from service providers such as hosting, app-store, payment, communications, security, and support providers; and
• from public and licensed sources, including government weather and environmental datasets. Those datasets generally describe places and conditions rather than individual Service users.

4. Cookies, Analytics, and Device Storage

The consumer app and website may store saved locations, preferences, recent forecasts and observations, map state, and optional notes or annotations locally on your device. The website may use browser local storage to cache weather responses and improve speed. These local items remain until they expire under the cache policy, you clear them, reset the app or browser, or uninstall the app. Accountless local items are not synced to a Weatherkind account.

We use Google Analytics to understand how the website is used—which pages are visited, roughly where visitors are, and which referrers send traffic. It sets two first-party cookies, named _ga and _ga_ followed by a property identifier, which persist for up to two years and hold a randomly generated identifier. Our tag denies advertising storage, ad personalization, and advertising user data outright, so no advertising identifiers are set from this site, and we do not sell or share this information for cross-context behavioral advertising. Google processes this data as our service provider. Analytics is the only cookie-setting technology on this site.

Where consent is required—the European Economic Area, the United Kingdom, and Switzerland—analytics storage is denied by default and no analytics cookie is written unless you accept. We determine this from the country your network connection resolves to. Elsewhere, analytics runs by default. You can change or withdraw your choice at any time using the Cookie settings link in the footer of any page, from anywhere in the world. Declining also deletes any analytics cookie already stored on your device. Your choice is recorded in your browser's local storage rather than in a cookie, so declining does not itself write the kind of file you declined.

We honor the Global Privacy Control signal. If your browser sends it, analytics storage stays denied regardless of your location, and we do not ask.

If you grant device-location permission, the app uses location to request weather for where you are. You can deny or revoke permission in device settings and enter a place manually. Mobile platforms and app stores may independently collect installation, purchase, diagnostic, and usage information under their own policies.

5. How We Use Information

We use personal information to:

• provide weather responses, accounts, API access, dashboards, station connections, rules, notifications, verification, support, and other requested features;
• authenticate users and API clients; meter usage; enforce scopes, quotas, and plan terms; record and enforce agreement to our legal terms; process transactions; and administer accounts;
• route, cache, debug, maintain, monitor, and improve the reliability, coverage, performance, and usability of the Service;
• detect, investigate, and prevent abuse, fraud, credential compromise, security incidents, and violations of our Terms;
• send transactional messages, requested alerts, waitlist or beta invitations, product notices, support replies, and—with any consent required by law—marketing communications;
• create aggregated or de-identified statistics, forecast verification, and service insights that do not reasonably identify an individual; and
• comply with law, respond to lawful requests, establish or defend legal claims, enforce agreements, and protect people, rights, and property.

We do not use weather requests to infer sensitive traits, build advertising profiles, or follow you across unaffiliated apps or websites. We do not use solely automated processing to make decisions about people that have legal or similarly significant effects. Mission Control may automatically evaluate a rule and send a notification, but the customer decides the rule and remains responsible for operational decisions.

6. Forecast Generation and Weather Sources

Weatherkind generates forecasts on servers we control by processing and blending numerical weather prediction guidance, including model guidance published by NOAA and ECMWF. We generally retrieve model datasets independently of individual requests. For alerts, observations, air quality, radar, maps, history, climate, geocoding, and similar features, our servers may query government, public, or licensed sources such as the U.S. National Weather Service and EPA AirNow.

A source may receive the coordinate, area, or other parameter needed to answer a query. When we proxy the request, it generally receives our server network information rather than a direct request from your device. Data publishers operate under their own terms and privacy practices, which we do not control.

7. How We Disclose Information

We may disclose personal information to:

• Service providers: companies that provide cloud hosting and storage (including Amazon Web Services), security, communications, payment, app distribution, customer support, and professional services under contractual restrictions.
• Your organization and integrations: account owners, administrators, authorized users, alert recipients, webhook or communications providers, and other systems you direct us to use.
• Weather and map sources: when a coordinate, area, or query is needed to retrieve requested source material.
• Authorities and affected parties: when we reasonably believe disclosure is required by law or necessary to enforce terms, protect rights or safety, investigate abuse, or respond to an emergency or security incident.
• Transaction participants: advisers, counterparties, and successors in connection with financing, diligence, reorganization, merger, acquisition, or sale, subject to appropriate confidentiality protections.

We may disclose aggregated or de-identified information that cannot reasonably identify you. We do not sell personal information, share it for cross-context behavioral advertising, or disclose it to advertising networks. We have not done so in the preceding 12 months. We do not offer financial incentives for personal information.

8. Business Customers and End-User Data

A business customer may send us coordinates, station information, contact details, or other data about its personnel, customers, or end users through Mission Control or the API. When we process personal information solely on that customer's documented instructions, the customer is the controller or business and Weatherkind is its processor or service provider. The customer is responsible for its notices, consents, legal basis, instructions, and responses to individual-rights requests. If your request concerns data controlled by a customer, we may direct you to that customer.

9. Retention

We keep personal information only as long as reasonably necessary for the purposes described here, including providing the Service, maintaining security and continuity, resolving disputes, and meeting tax, accounting, and legal obligations. Retention depends on the type of data and product:

• local app and browser data remains until its cache expires or you clear, reset, or uninstall it;
• website infrastructure logs are generally retained for 30 to 90 days, though security records associated with an incident may be kept longer;
• waitlist information remains until you ask us to delete it, the waitlist is retired, or it is converted into an account or business relationship;
• account, API, Mission Control, configuration, station, and usage data remains while the account or contract is active and for a reasonable period afterward for deletion, backup, security, support, and dispute handling;
• transaction and contract records may be kept for the period required by tax, accounting, and other law; legal-acceptance records may also be retained as reasonably necessary to establish or defend legal claims; and
• support and sales communications remain while relevant to the relationship and for a reasonable recordkeeping period afterward.

Backup copies may persist for a limited additional period before rotation. We may retain aggregated or de-identified information where we maintain it in that form and do not attempt to re-identify it.

10. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information, including access controls, encryption in transit where supported, protected cloud storage, logging, rate limiting, and abuse protections. No transmission, storage, or system is completely secure. You are responsible for protecting your devices, accounts, API keys, integrations, and connected stations and for notifying us promptly of suspected unauthorized access.

11. International Processing

Weatherkind is based in the United States, and we and our service providers may process information in the United States and other countries whose laws may differ from those where you live. Where applicable law requires a transfer mechanism, we use an approved mechanism such as standard contractual clauses or another lawful safeguard. You may contact us for more information about applicable safeguards.

12. Legal Bases for Processing

Where EEA, UK, or similar law requires a legal basis, we process personal information as necessary to perform a contract or take steps you request before entering one (for example, to provide an account, API response, alert, or support); to comply with legal obligations; and for our legitimate interests in securing, supporting, measuring, and improving the Service, administering our business, preventing abuse, and communicating about related products, where those interests are not overridden by your rights. We rely on consent where required, such as for device-location permission or certain marketing, and you may withdraw consent at any time without affecting earlier processing.

13. Your Choices and Privacy Rights

You may revoke device-location permission in system settings; clear local app or browser data; manage organization, alert, and account settings; rotate API keys; and unsubscribe from non-transactional email using the message instructions or by contacting us. You may still receive service, billing, security, or legal notices.

Depending on where you live and subject to legal exceptions, you may have the right to know or access personal information; obtain a portable copy; correct or delete it; restrict or object to processing; withdraw consent; and opt out of sale, targeted advertising, or certain profiling. Because we do not sell personal information or use it for targeted advertising or legally significant profiling, there is no separate opt-out needed for those practices. Where required, we honor recognized universal opt-out signals for practices to which they apply.

Where applicable, you have the right to object to processing based on our legitimate interests and to object at any time to direct marketing.

To make a request, email hello@weatherkind.com with "Privacy Request" in the subject. Describe the product and the right you wish to exercise. We may verify your request in a manner proportionate to the information involved. An authorized agent may submit a request where permitted, but we may require proof of authority and direct identity verification. You may appeal a denied request by replying with "Privacy Appeal." We will not discriminate against you for exercising a privacy right.

Accountless requests are not associated with a user profile, so we may be unable to link a server log or cached weather request to you. We will explain when we cannot reasonably verify or fulfill a request. You may also complain to your local data-protection or privacy regulator.

14. California and Other U.S. State Disclosures

The categories in Section 2 correspond to identifiers; customer-record and commercial information; internet or electronic-network activity; precise geolocation when you choose to provide it; professional or employment-related information; and inferences limited to product and support needs. Sections 3, 5, 7, and 9 describe the sources, business purposes, recipient categories, and retention criteria for those categories. We do not knowingly sell or share the personal information of consumers under 16. Nothing in this section limits rights available under Colorado, California, or other applicable state law.

15. Children's Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from a child under 13. API keys, paid plans, and business administration are limited to adults. If you believe a child has provided personal information, contact us so we can investigate and delete it as appropriate.

16. Changes to This Policy

We may update this Privacy Policy as our products and practices change. We will post the revised Policy, update the date above, and provide additional notice of material changes when required by law. If we plan to use personal information for a materially different purpose, we will provide notice and obtain consent where required before doing so.
